Foreign yachts can continuously stay in Hainan for 30 days at most after arriving since April 15, 2011. In addition an extension can be applied after expiration. The in-and-out procedures for yachts will be simpler and the supervisions from General Administration of Customs of PRC (hereinafter referred to as China Customs) will be more normative. The Administration of Customs of Haikou City held a news conference on March 18 with the title of Supervision Interim Measures of General Administration of Customs of PRC for In-and-Out Yachts and Loads in Hainan Province (hereinafter referred to as Measures). During the conference, Supervision Interim Measures of General Administration of Customs of PRC for In-and-Out Yachts and Loads in Hainan Province issued on March 11 was interpreted.
 
In order to support the development of yacht industry in Hainan Province, there are the following breakthroughs in the above mentioned Measures to be enforced on April 15. Firstly it is customized for Hainan Province. The Measures was drafted by the China Customs according to the policies of “research and completion” and “first implementation & try” endowed by the nation for Hainan Province of yacht management during the construction of International Tourism Destination. Moreover, it is a customized supervision measures for in-an-out yachts in Hainan Province by the General Administration of Customs of PRC and one of its important measures supporting the construction of Hainan International Tourism Destination.
 
Secondly it increases in-and-out locations for yachts. It specifies that besides berthing, entering and departing in docks of open ports, yachts can also enter and depart in approved yacht supervision docks.
 
Thirdly the guarantees for yachts are flexible. The Measures specifies that the yacht principal shall submit guarantee money equivalent to tax payment of the yacht to the China Customs. The guarantee can be margin or others legally approved by the China Customs, including total guarantee for the received yachts by yacht service companies after being approved by the General Administration of Customs of PRC. Only one procedure is needed for general guarantee of yacht service companies in China Customs, i.e. it can provide guarantee for a certain number of yachts in given period.
 
Fourthly the in-and-out procedures are simpler. The Measures specifies that besides offering guarantee, the procedures for in-and-out application are managed according to that for means of transport. All the procedures are simpler.
 
Fifthly the staying time of foreign yachts will better meet the vacation requirement. The Measures indicates that the foreign yachts are able to continuously stay in Hainan for 30 days at most after arriving. Twice extensions can be applied after expiration with each extension not more than 30 days.
 
Sixthly the supervision from China Customs will be more normative. The Measures provides specific regulations in terms of yacht’s in-and-out supervision, entry-departure period supervision, legal obligations, etc. to provide effective basis for law enforcement by China Customs.
 
It is reported that compared with the content of customs supervision in Trial Managem
ent Measures for Yacht in Hainan Province issued in the end of last year, the Measures only gives principle description. The General Administration of Customs of PRC specially issued the Measures according to the document requirement of the State Council from the standpoint of performing customs management duty and specifying the in-and-out supervisions for yachts in Hainan Province. This Measures is the effective law enforcement basis for supervision of in-and-out yachts and loads in Hainan Province by China Customs. Compared with Trial Management Measures for Yacht in Hainan Province, the yacht supervision measures issued by China Customs mainly focus on the supervision to in-and-out yachts and the loads.
